Welcome to shopcreativepea.com, operated by Creative Pea LLC (“Creative Pea,” “we,” “our,” or “us”). This Agreement governs your access to and use of our website (the “Site”) and your purchase of any products (“Products”) from the Site. By accessing or using the Site — or placing an order — you agree to be bound by this Agreement, our Privacy Policy, and all applicable laws.

If you do not agree to or cannot comply with any term of this Agreement, you must not use or access the Site.

1. Eligibility & Use of the Site

  • You must be at least 18 years old (or of legal age in your jurisdiction) and able to form a binding contract with Creative Pea.
  • Any use of the Site by anyone previously suspended or prohibited from the Site is not allowed.

  • We reserve the right to suspend, block, or terminate access at any time for any reason.

2. Products, Orders & Acceptance

  • All product descriptions, images, and pricing are subject to change at any time without notice. While we strive for accuracy, we do not warrant that product descriptions or other content on the Site are complete or error-free.
  • Your order constitutes an offer to purchase. We may accept or reject your order at our discretion. If we reject an order, we will refund any payment you made.

3. Pricing & Payment

  • Prices displayed are in USD and exclude applicable taxes and shipping (unless stated otherwise).
  • Payment must be made via the methods provided at checkout. You represent that any payment information you provide is accurate, current, and complete.
  • We reserve the right to correct any pricing errors or change prices for orders placed in error.

4. Shipping, Delivery & Risk of Loss

  • We describe our shipping methods, delivery times, and fees on our Shipping Policy page. That policy is incorporated into this Agreement by reference.
  • Title and risk of loss pass to you when we hand over the shipment to the shipping carrier.

5. Returns, Refunds & Cancellations

  • Our Return and Refund Policy (or “Refund Policy”) governs returns, cancellations, refunds, and exchanges. That policy is incorporated into this Agreement by reference.
  • Unless otherwise stated, we reserve the right to reject returns or exchanges that do not meet the conditions defined in our policy.

6. Intellectual Property / Proprietary Rights

  • All content on the Site — including text, graphics, logos, images, product descriptions, and software — is the property of Creative Pea (or its licensors) and is protected by copyright, trademark, and other IP laws. 
  • You may not copy, reproduce, distribute, or create derivative works from the Site’s content, except as explicitly permitted.

7. User-Submitted Content & Feedback

  • If you submit ideas, feedback, or suggestions (“Feedback”), you grant Creative Pea a nonexclusive, royalty-free, irrevocable, worldwide license to use, distribute, modify, and otherwise exploit such Feedback.

8. Disclaimer of Warranties; No Guarantee

  • The Site and all content are provided “as is” and “as available.” To the fullest extent permitted by law, Creative Pea disclaims all warranties — express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We make no guarantee that the Site will be error-free, secure, uninterrupted, or free of harmful components (e.g. viruses).

9. Limitation of Liability

  • To the maximum extent permitted by applicable law, Creative Pea (and its affiliates) will not be liable for any indirect, special, incidental, punitive, or consequential damages arising from your use of (or inability to use) the Site, even if advised of the possibility of such damages.
  • Our total liability to you for any claim arising from or related to this Agreement or the Site will not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim or (ii) US $100.

10. Governing Law & Dispute Resolution

  • This Agreement and any disputes arising from it will be governed by the laws of the state where Creative Pea is registered (Florida), without regard to conflict-of-law principles.
  • You and Creative Pea agree that any dispute will be resolved by binding individual arbitration (not class action), and you waive any right to a court trial or jury trial.

11. Changes to the Terms

  • We reserve the right to modify or update this Agreement at any time. We’ll indicate a “Last updated” date at the top.
  • Continued use of the Site after any changes means you accept the revised terms.

12. Severability & No Waiver

  • If any part of this Agreement is held invalid or unenforceable under applicable law, the remaining provisions remain in effect.
  • Failure by Creative Pea to enforce any right or provision does not constitute a waiver of that right or provision.
